1. Agreement Acceptance
By purchasing any reptile or product from Majestic Reptiles (“Seller,” “we,” “our,” or “us”), you (“Buyer” or “Customer”) agree to all terms and conditions listed herein. These Terms & Conditions form a legally binding agreement and remain in effect for all purchases, communications, and transactions with Majestic Reptiles. Any Buyer who does not agree to these terms must not complete a purchase.
2. Notice of Binding Terms and Right to Refuse Sale
Failure to read or acknowledge these Terms and Conditions—intentionally or unintentionally, and regardless of where the Buyer encountered our advertisement or listing—shall not constitute grounds to alter, void, or exempt any portion of this Agreement. These Terms remain fully enforceable and binding upon all purchasers. Majestic Reptiles reserves the right to refuse or cancel a sale at its sole discretion, at any time, with or without justification—even after payment has been submitted. In such cases, our sole obligation is to refund the purchase price; a full refund will be issued to the Buyer within seven (7) business days of cancellation, and the transaction shall be considered null and void. We are not responsible for consequential or incidental damages. This right is exercised to maintain the safety, reputation, and operational integrity of our business.
Majestic Reptiles’ decisions regarding refunds, replacements, cancellations, or disputes shall be considered final and conclusive, except where otherwise required by applicable law.
3. Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
Except as expressly carved out below, all disputes and claims arising from or relating to this Agreement, its interpretation, performance, or breach, shall be resolved exclusively through the binding arbitration process described in Section 3.1.
For the limited purpose of confirming, enforcing, or vacating an arbitration award, the parties agree that jurisdiction and venue shall lie exclusively in the state or federal courts located in the County where the Seller conducts business. Each party consents to the personal jurisdiction of such courts solely for these purposes.
3.1 Alternative Dispute Resolution
- (a) Mandatory Mediation: Prior to initiating litigation, both parties agree to attempt in good faith to amicably resolve any dispute arising from this Agreement through mediation. If the matter remains unresolved after mediation, it shall be submitted to binding arbitration under the rules of the American Arbitration Association in the County where Majestic Reptiles operates. The parties shall mediate in good faith for at least thirty (30) days before initiating arbitration.
- (b) Arbitration Venue and Rules: If mediation fails to resolve the dispute, it shall be submitted to final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules then in effect, to be conducted in the County where Majestic Reptiles maintains its principal place of business, unless both parties agree in writing to a different venue.
- (c) Arbitration Fees and Attorneys’ Fees: If either party initiates mediation and/or arbitration, the initiating party shall be solely responsible for all mediator or administrative filing costs associated with such mediation or arbitration. Each party shall be solely responsible for its own attorney’s fees and related expenses in connection with mediation or arbitration, unless otherwise required by applicable law and except as otherwise expressly provided in this Agreement (including Section 13.1) or as specifically awarded by the arbitrator or a court of competent jurisdiction.
- (d) Carve‑Out for Specific Claims: This clause does not restrict Majestic Reptiles from filing claims in court for intellectual property claims, defamation, reputational harm, or seeking injunctive or equitable relief necessary to protect its business interests, including claims or actions in connection with Buyer’s resale or attempted resale of animals to any blacklisted individual, company, or entity as described in Section 10.
- (e) Enforcement of Award: Except for the carve‑outs expressly stated in subsection (d), arbitration under this Section is the sole and exclusive means of resolving disputes arising out of or relating to this Agreement, and the arbitration award shall be final and binding on the parties. Judgment on the award may be entered exclusively in the state or federal courts located in the County where Majestic Reptiles conducts business, and each party consents to personal jurisdiction and venue in such courts solely for that purpose.
- (f) Scope of Arbitrator Authority on Costs and Fees: Nothing in this clause shall preclude the arbitrator from awarding costs, expenses, or attorneys’ fees as permitted by applicable law or by the rules of the American Arbitration Association.
4. Payment & Deposits
- (a) All prices are listed in U.S. Dollars.
- (b) Within 14 days of any new listing, we will only accept full payment. Payment plans may be considered thereafter on a case-by-case basis.
- (c) Due to the high rate of scams and fraud ravaging the reptile community, Majestic Reptiles only accepts non-reversible payment methods, including Zelle, Cash App, and bank wires. We do not accept cryptocurrencies.
- (d) International purchases are not accepted unless explicitly pre-approved in writing. Majestic Reptiles is not responsible for customs seizures or legal consequences of unauthorized international transactions.
- (e) Animals are not shipped until all payments have cleared fully. Pending transactions (including bank holds) do not constitute payment.
- (f) All sales are final once final payment is cleared. Refunds, credits, or replacements are not offered except in explicitly approved, exceptional cases at the sole discretion of Majestic Reptiles, such as Seller error or DOA (see Section 7).
5. Shipping & Delivery Policy
- (a) Shipping is available within the continental U.S. exclusively.
- (b) Standard shipping (overnight, priority) is included in the animal price unless otherwise noted. Shipping costs for heavy or adult animals may be priced separately.
- (c) All shipments are professionally packed and may include heat or cool packs based on weather conditions.
- (d) Buyer must pick up the animal from an approved, staffed FedEx Hub location. No home deliveries are permitted.
- (e) Buyer must retrieve the animal within one hour (local time) from the time it is recorded as available for pickup at their designated FedEx Hub. Failure to do so voids any live‑arrival or health guarantees, as delays in retrieval can result in prolonged exposure to cold and may lead to respiratory infections and/or extreme stress.
- (f) For purposes of enforcing this requirement, the timing of arrival, pickup availability, and delivery status shall be determined solely by the official tracking information provided by the shipping carrier, as such real‑time scans are the controlling record, and not by any statements or representations from the Buyer or any third party.
- (g) We may use authorized FedEx dealers such as Reptiles Express, Ship Your Reptiles, MorphMarket, or Delta Cargo as deemed appropriate.
- (h) If temperatures are below 50°F or above 89°F anywhere along the shipping route (departure point, mid-stop point, and arrival point), shipments may be delayed until weather and transit conditions are deemed safe and ideal.
- (i) Purchases made during winter may be held at our discretion until conditions are deemed safe and ideal.
- (j) Overnight shipments will only be made from Mon – Wed to reduce the risk of animals getting held with the carrier on weekends in case of shipping delays. Additionally, no shipments willl be made during or in anticipation of national holidays or severe weather warnings.
- (k) If someone other than the Buyer picks up the package—whether a friend, family member, agent, or third party—all warranties, guarantees, and conditions of this Agreement remain fully binding. The Buyer is solely responsible for ensuring that pickup is handled in accordance with these Terms, and no exceptions will be made based on who physically receives the package.
- (l) If the Buyer alters the shipment route, destination, or delivery method while the package is in transit—whether by contacting the carrier directly or through any third-party intervention—all warranties, guarantees, and claims become immediately void.
- (m) Buyer assumes all responsibility for compliance with any carrier‑specific pick‑up requirements, including but not limited to identification and documentation requirements imposed by the carrier or its authorized agents. This does not alter or extend Buyer’s obligation under these Terms to retrieve the animal within one (1) hour of arrival.
5.1 Incorrect Shipping Information Provided by Buyer
- (a) If the Buyer provides inaccurate, incomplete, or incorrect shipping information—regardless of how minor—that results in a delay, misdelivery, or the package being routed to the wrong location, all guarantees, warranties, and claims are immediately voided.
- (b) This includes situations where the Buyer does not receive the animal due to their own error. No refunds, replacements, or credits will be issued in such cases.
- (c) An exception may be made only if the shipping carrier returns the package to Majestic Reptiles promptly and the animal arrives in the same health condition in which it was shipped. However, due to the high stress and potential risk of illness during prolonged or failed transit, Majestic Reptiles may withhold any refund or credit for a period of up to 30 days while the animal is monitored for signs of stress-related health issues, such as respiratory infection or appetite loss. If the animal shows any health deterioration during this observation period, no refund or replacement will be issued.
- (d) If the animal is found to be in the same healthy condition as when it was originally shipped, a 35% administrative fee will be deducted from any approved refund to account for the extended care, handling, and lost sale opportunity.
5.2 Pre‑Shipping Feeding & Establishment Standards
- (a) Majestic Reptiles maintains strict pre‑shipping standards to protect both our animals and our customers. No neonate or juvenile animal will be shipped until it has taken a minimum of eight (8) successful meals without regurgitation, demonstrating that it is feeding reliably and without issue.
- (b) If an animal sold as part of a litter exhibits poor feeding response or otherwise fails to meet this 8‑meal threshold, Majestic Reptiles will promptly notify the Buyer and offer one of the following options:
- A full refund for that specific animal, or
- A replacement animal of comparable value, if one is available.
- (c) Sales remain on a per‑animal basis (see Section 8). Even if animals were purchased together (e.g., as a 1.1 pair), each animal is handled independently.
- (d) No exceptions will be made to this standard. Buyer may not request shipment of an animal that has not met the 8‑meal threshold, even if Buyer offers to “work with” the animal or assumes the risk. This strict policy is in place to prevent unnecessary risk, stress, or loss that could lead to disputes or reputational harm.
- (e) Additional Time for Stubborn Eaters: While many neonates establish quickly, some otherwise healthy animals may intermittently skip meals while still maintaining normal condition. In such cases, Majestic Reptiles may, at our reasonable judgment, extend the establishment period beyond the initial 8‑meal threshold.
- (f) For fairness and to ensure the Buyer receives an animal in optimal condition, we may hold an animal for up to four (4) additional feeding cycles if we determine that extra observation or conditioning is appropriate, or if we believe the Buyer may have difficulty managing a more challenging feeder.
- (g) This extended period does not indicate that the animal is defective or unhealthy, as intermittent feeding behavior can be normal in neonates. After this additional observation period, Majestic Reptiles will either proceed with shipment if the animal meets our standards, or offer a refund if we deem the animal to be in less‑than‑ideal condition.
5.3 Insurance & Risk of Loss
Majestic Reptiles professionally packs all animals using industry‑standard methods but does not provide or include any shipping insurance. Buyers may request and pay for insurance in writing prior to shipment, and any such insurance will be arranged through the carrier, subject to the carrier’s own terms.
Majestic Reptiles is not responsible for losses, delays, or damages occurring during transit that are not covered by the carrier’s standard liability, and no claims will be honored for uninsured shipments. Even if insurance is purchased through the carrier, Majestic Reptiles shall not be responsible for any mishandling, delays, or damages caused by the carrier beyond the amounts actually recovered through such insurance. Risk of loss transfers to the Buyer once the animal is accepted by the carrier.
Majestic Reptiles is not a shipper or insurer and assumes no carrier liability beyond those outlined.
6. Live Arrival Guarantee & Health Policy
- (a) All animals are maintained and sold in accordance with applicable animal welfare standards, including the U.S. Animal Welfare Act and relevant state or local regulations, to the best of Seller’s knowledge and ability.
- (b) All listed animals are guaranteed to be free of mites, kinks, prolapse, external or internal parasites, respiratory infections, and regurgitation issues.
- (c) Majestic Reptiles guarantees that all animals are delivered alive, in good health, and accurately sexed to the best of our knowledge at the time of shipping. However, we do not extend any ongoing health, behavior, or feeding guarantees beyond the point of arrival. Once the animal is in the Buyer’s care, all responsibility for its health, well-being, and environment rests solely with the Buyer, as post-arrival conditions fall outside our control.
- (d) Live Arrival Guarantee applies exclusively when the Buyer picks up the animal on time (see Section 5), in person, from the FedEx Hub. Missed or delayed pickups void all guarantees.
- (e) Dead on Arrival (DOA) claim requires an unedited, five-minute continuous video taken from multiple angles upon unboxing (no scene cuts permitted). The animal must remain untouched and fully visible in the original shipping container during the entire 5-minute unboxing video. Majestic Reptiles also reserves the right to request a live video call (e.g., FaceTime) in addition to the video. No exceptions.
- (f) If a shipping delay occurs that is outside our control and the Buyer did not arrange additional insurance prior to shipment, all live‑arrival guarantees, health guarantees, and eligibility for DOA claims are automatically void. Live reptiles are highly susceptible to stress, illness, or death when delayed in transit, and without insurance coverage, such risks are accepted entirely by the Buyer. No refunds, credits, or replacements will be issued in these cases.
- (g) DOA claims are valid only if all preceding obligations in Sections 5, 5.1, and 5.3 have been met.
- (h) Although extremely rare, misgendering can happen. The listed gender is not guaranteed and no refunds or replacements can be provided for a misgendered reptile sold to the Buyer.
- (i) Feeding behavior is not guaranteed post-shipping, especially in adult males or stressed animals. Buyer understands that temporary fasting is normal.
- (j) Majestic Reptiles does not knowingly sell animals that have experienced regurgitation in the past, even if it occurred once, unless disclosed prior to sale. Therefore, any regurgitation issues that arise while the animal is in the Buyer’s care are not the responsibility of the Seller, since regurgitation can be due to reasons outside the Seller’s control, such as:
- Stress;
- Poor husbandry;
- Dehydration;
- Improper temperatures or humidity;
- Meals being too large;
- Rodents being thawed for too long, hence developing bacteria;
- Rodents being fed too soon before fully thawed (still cold or internally frozen);
- Poor practices with rodent supplier;
- Viruses, Mites or parasites caused by the Buyer’s collection;
- Or multiple factors together.
- (k) While Majestic Reptiles guarantees that all animals appear visibly healthy, alert, and responsive at the time of shipment, we make no representations regarding internal conditions that are not externally detectable. We are not liable for any internal or congenital conditions that may become apparent after delivery—such as cardiac abnormalities, gastrointestinal blockages, liver failure, or other organ-related issues—as these cannot be reasonably identified prior to shipping in healthy-appearing reptiles.
- (l) Seller will provide limited instructions to Buyer on actions to take to alleviate any potential issues with respect to animal health.
- (m) Buyer agrees that Majestic Reptiles is not liable for delayed-onset illness, regurgitation, or death occurring after delivery, regardless of cause or suspected origin, unless otherwise stated in writing as part of a rare exception. All post-arrival health risks are the Buyer’s sole responsibility as outlined in this section.
- (n) Majestic Reptiles is not responsible for any veterinary fees incurred by the Buyer under any circumstances, including but not limited to diagnostic testing, treatment, or preventative care. All veterinary decisions and expenses are the sole responsibility of the Buyer.
- (o) Majestic Reptiles is not liable for loss, death, or illness of animals in the Buyer’s collection due to inadequate quarantine practices.
6.1 Quarantine & Exception Review Conditions
- (a) In order for any health-related concern to be considered under the rare exception protocols outlined in Section 7 (Refunds, Replacements & Dispute Resolution), which applies only to rare, pre-approved cases, the Buyer acknowledges that they are solely responsible for understanding and implementing appropriate reptile quarantine procedures. By completing a purchase, the Buyer affirms that they possess a basic working knowledge of reptile quarantine practices and agrees to maintain a secure, isolated environment that prevents exposure to their existing collection.
- (b) A quarantine instruction sheet may be included with the shipment as a courtesy reference, outlining the minimum setup criteria required for Majestic Reptiles to consider evaluating any health-related concern. However, this document does not relieve the Buyer of their independent obligation to implement a safe and compliant quarantine environment.
- (c) To be eligible for review, the Buyer must submit clear photo or video documentation—within 6 hours of delivery—showing the exact animal received, housed in a setup that meets or exceeds the criteria provided. Submissions received after this window or setups deemed unsafe, inadequate, or unsuitable shall automatically void all eligibility for refunds, credits, or returns.
- (d) Majestic Reptiles retains sole discretion in determining whether a quarantine setup qualifies for consideration under a rare exception review, regardless of whether documentation was submitted or a guidance sheet was received.
- (e) Buyer understands that exceptions are not automatic rights and will only be considered in limited circumstances as outlined in this Agreement.
- (f) We strongly advise that the quarantine setup be fully prepared prior to the animal’s arrival, and encourage Buyers to contact us with any questions or clarifications in advance—we welcome all pre-arrival inquiries to help ensure readiness. Failure to do so does not relieve the Buyer of their responsibilities under this Agreement. Ultimately, all responsibility for proper quarantine remains solely with the Buyer.
6.2 Veterinary Documentation & Verification Requirements
- (a) Any health‑related concern raised after delivery must be supported by written documentation from a licensed reptile veterinarian, including the veterinarian’s full contact information for direct verification. Such documentation must be provided to Majestic Reptiles within seventy‑two (72) hours of delivery. Claims submitted after this period will not be considered. Failure to provide such documentation within this timeframe shall permanently bar any related claims, regardless of circumstances. In cases requiring laboratory testing, self‑collected swab tests, unverifiable lab results, or home diagnostics are not accepted due to the risk of contamination or procedural errors.
- (b) Majestic Reptiles reserves the right to contact the veterinarian directly to confirm that the animal examined matches the one sold, and to validate all findings. We also may conduct independent testing through a third‑party licensed reptile veterinarian. Buyer agrees to cooperate and to allow reasonable time for such testing.
- (c) If third‑party test results do not corroborate the Buyer’s claims, the animal will be returned to the Buyer only after the Buyer prepays all associated costs—this includes all shipping fees, veterinary costs, feeding, housing, and materials incurred during the evaluation process. Failure to pay these costs within thirty (30) days forfeits all rights to the animal and any prior payments. In such cases, Majestic Reptiles is permitted to retain or resell the animal to recoup costs.
7. Refunds, Replacements, & Dispute Resolution
- (a) Returns are never accepted for animals exposed to the buyer’s environment, period.
- (b) Majestic Reptiles adheres to strict biosecurity protocols to protect the health and safety of our collection. For this reason, we do not accept the return of any reptile once it has been exposed to the Buyer’s collection or environment, as doing so poses immeasurable risk to both our animals and our business. This policy is non-negotiable and exists to prevent potential cross-contamination and safeguard the integrity of our facility.
- (c) Majestic Reptiles maintains a strict no-return and no-refund policy on all purchases, including orders that have not yet been shipped. This policy applies equally to animals purchased individually, in pairs, or as part of a group.
- (d) All sales are final and non-reversible once payment has been submitted. Refunds or credits are not offered except in explicitly approved, exceptional cases at the sole discretion of Majestic Reptiles.
- (e) One such rare exception is outlined in Section 5.1, where a refund may be considered if the shipping carrier returns an animal in perfect health due to Buyer error in providing incorrect shipping information. In that case, a 35% administrative fee is applied to account for extended care, handling, and lost sale opportunity. This example is illustrative only and does not constitute a general rule.
- (f) All live‑arrival guarantees and any eligibility for refunds based on DOA claims are subject to the conditions in Section 6, including the requirement that shipments arrive on time and the Buyer’s responsibility for arranging insurance. Carrier delays on uninsured shipments void all such guarantees.
- (g) Unauthorized returns are void and will not be accepted.
- (h) In extremely rare and strictly pre-approved cases, Majestic Reptiles may authorize a return at our sole discretion (rare exception protocols). Under no circumstances will returns be accepted if the animal has been exposed to the Buyer’s collection or environment (see Section 6.1 for quarantine guidelines). Unauthorized or post-exposure returns are strictly prohibited and will be voided upon arrival.
- (i) In the rare and exceptional event that Majestic Reptiles, at its sole discretion, authorizes a return, refund, or credit as an exception to our no-refund policy, the animal must first be received, inspected, and evaluated by our team. If a refund or credit is approved following this process, a 35% cancellation fee will be applied to cover administrative, processing, and handling costs.
- (j) If the returned animal is found to be in a condition that is meaningfully different from when it was originally shipped—due to stress, injury, illness, or neglect while in the Buyer’s care—any refund or credit may be reduced accordingly, or voided entirely if the animal is deemed unfit for resale. In such cases, Majestic Reptiles reserves the right to retain the animal and withhold reimbursement.
- (k) Replacement animals, if approved, are subject to availability and may differ in lineage, appearance, sex, or value. We do not guarantee identical or equivalent replacements, nor do we guarantee a replacement will be immediately available.
- (l) The no-return and no-refund policy outlined in this section applies equally to all transactions, including those claimed to be accidental or submitted from jurisdictions outside the United States. Claims of accidental purchase do not exempt the Buyer from these Terms or entitle them to a refund.
- (m) For clarity, animals that do not yet meet the feeding and establishment standards outlined in Section 5.2 will not be shipped under any circumstances. Any pressure or request to waive these standards does not obligate Majestic Reptiles to ship early, and does not create any additional rights or remedies beyond the refund or replacement options already described in Section 5.2.
- (n) Buyer agrees to indemnify and hold harmless Majestic Reptiles from any claims, damages, legal fees, or disputes arising from false, exaggerated, or unsupported allegations.
- (o) Notice Period (For Communication Purposes Only): Any concerns, complaints, or questions must be raised within 7 calendar days of delivery to be considered for response. This clause does not imply eligibility for refunds or exceptions, which remain subject to all requirements in Sections 6, 6.1, and 7, and are granted only at the sole discretion of Majestic Reptiles.
8. Individual Animal Sales
- (a) Each animal sold by Majestic Reptiles is treated as a separate and individual sale, regardless of whether it was purchased as part of a pair, trio, or group (e.g., 1.1, 2.2, etc.).
- (b) Purchasing multiple animals together does not constitute a bundled or collective transaction, nor does it create shared warranties or obligations across the group.
- (c) Any refund, replacement, or evaluation — if ever granted — applies only to the specific animal in question and will not extend to any other animal in the same order, even if purchased together or housed together by the Buyer.
- (d) A health issue, injury, misidentification, or defect affecting one animal — even if determined to be the fault of the Seller — does not entitle the Buyer to a refund, return, or replacement of the remaining animals in the group.
- (e) Language such as “sold as a pair,” “1.1,” “2.2,” or similar terms — including cases where the Buyer requests to purchase animals only as a pair or group — is common in the reptile industry and refers only to how the animals are marketed or grouped for sale. This does not create a bundled warranty or imply that the transaction is conditional upon the animals remaining together as a unit.
- (f) Discounted pricing for pairs or groups is offered solely for promotional and marketing purposes to encourage sales and does not create a package deal, joint liability, or bundled warranty.
- (g) The use of promotional terms such as ‘proven pair’ or ‘breeder-ready trio’ does not create any implied breeding guarantee or shared refund eligibility across the animals.
- (h) Each case will be evaluated on its own merits, and all sales are considered per-animal transactions, with no shared or collective warranty implied.
- (i) To the maximum extent permitted by applicable law, the refund, return, and biosecurity policies in this Section 7 shall govern; if any jurisdiction prohibits certain limitations, those prohibited limitations shall not apply, and the remainder of these policies shall remain in full force and effect.
9. Buyer Responsibility & Knowledge Requirement
- (a) Buyer affirms they possess adequate knowledge, skill, preparation, and proficiency in caring for exotic reptiles, especially high-value snakes.
- (b) Majestic Reptiles offers limited post-sale care advice but cannot be held responsible for Buyer husbandry errors or environmental stressors.
- (c) Long-term feeding success, temperament, reproductive capability, or growth are not guaranteed.
- (d) Buyer represents and warrants that their purchase and possession of the animal comply with all HOA bylaws, lease terms, and housing regulations, and have secured all necessary permissions. Buyer further affirms they have the facilities, time, financial resources, and experience necessary to care for the animal responsibly.
- (e) Buyer further agrees not to place the animal in any environment or condition that would compromise its health, safety, or survivability, and affirms that they possess all necessary tools, equipment, enclosures, and housing to maintain the animal in appropriate conditions at all times.
10. Resale Regulations & Ethical Standards
- (a) We maintain a blacklist of individuals/entities deemed unethical, irresponsible, or fraudulent, as well as parties/competitors who have attempted to lie about us, hurt our reputation or caused us trouble in any way.
- (b) Buyer may resell purchased animals only to non-blacklisted individuals, companies, or organizations.
- (c) Buyer acknowledges and agrees that resale to any blacklisted individual or entities, knowingly or unknowingly, constitutes a significant breach and shall result in automatic forfeiture of all future warranty, consultation, or support. Legal action may be pursued to recover damages or restrict further transfers.
- (d) Buyer agrees not to solicit, encourage, or engage third parties to take actions on their behalf that would violate any part of this Agreement in its entirety.
- (e) Buyer is solely responsible for ensuring that subsequent owners or transferees of the animal are informed of and comply with all applicable animal welfare, quarantine, and transport regulations.
11. Media Usage & Intellectual Rights
- (a) Majestic Reptiles retains full rights to any and all photos, videos, records, and documents created by us while animals purchased by Buyer were under our care.
- (b) We may use these materials for educational, promotional, or documentation purposes — even after the sale of the animal.
- (c) Buyer does not have the right to use any of our aforementioned materials for their own purposes without prior written permission.
- (d) Any use of our materials by Buyer and/or 3rd parties will be considered copyright infringement, and we hold the authority to pursue action to have the infringed materials removed.
12. Limitation of Liability
- (a) Majestic Reptiles is not liable for:
- (i) Any harm, injury, or property damage caused by animals sold;
- (ii) Death or illness of other reptiles due to inadequate Buyer quarantine;
- (iii) Delays caused by carriers (e.g., FedEx, UPS, airline services);
- (iv) Buyer negligence, improper husbandry, or failure to comply with local or federal wildlife laws.
- (b) In no event shall Majestic Reptiles be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of business, or reputational harm, even if advised of the possibility of such damages.
13. Confidentiality & Non-Disparagement
Buyer agrees that all disputes, concerns, or complaints regarding any transaction, animal, or service provided by Majestic Reptiles shall be addressed privately, professionally and in good faith, with the intent to resolve matters amicably and confidentially.
Under no circumstances shall Buyer:
- (a) Post, publish, disseminate, or share any false, defamatory, or misleading statements—whether written or verbal, online or offline, publicly or privately, including through social media, forums, reviews, emails, group chats, or direct messages—that could cause reputational or financial harm to Majestic Reptiles, its owners, staff, animals, services, or brand.
- (b) Post or leave any false, defamatory, or knowingly misleading reviews or commentary—including on MorphMarket, Google, Facebook, Instagram, YouTube, Reddit, X (Twitter), TikTok, or other platforms or marketplaces—that could harm the reputation or business interests of Majestic Reptiles, its owners, staff, animals, services, or brand.
- (c) Threaten to damage Majestic Reptiles’ reputation in exchange for a refund, replacement, or favorable outcome;
- (d) Provoke, pressure, harass or antagonize Majestic Reptiles or its representatives into a reaction over any disagreement, claim, or communication;
- (e) Exaggerate or misrepresent any aspects of their experience or facts related to the transaction or animal in a way that could cause reputational or financial harm;
- (f) Mention, imply, or threaten legal action, attorney involvement, or regulatory complaints in an attempt to pressure Majestic Reptiles into a specific action or compensation.
Buyers who violate of any of the above provisions—whether intentional or unintentional—shall result in the immediate forfeiture of all warranties, guarantees, and ongoing support. Majestic Reptiles reserves the right to immediately cease all communication and obligations without further notice in order to protect our legal interests and prevent escalation.
Nothing in this section shall prohibit Buyer from providing truthful, factual feedback that is not defamatory or misleading. This section is not intended to, and shall not, limit any rights under the Consumer Review Fairness Act or similar laws. This section is intended solely to protect our business interests against bad‑faith actors, unethical conduct, and communications made with reckless disregard for the truth, and is not intended to restrict good‑faith, factual reviews.
13.1 Legal Enforcement & Damages
Any act of defamation, slander, libel, or the publication of false or misleading statements—whether public or private—will be subject to legal pursuit to the fullest extent permitted by law. The Buyer agrees to be held financially liable for any reputational harm caused, and shall reimburse Majestic Reptiles for all related legal fees, filing costs, attorney retainers, expert witness expenses, and court-imposed damages as a result of such violations.
If Majestic Reptiles determines that any legal threat made by the Buyer is frivolous, in bad faith, or predicated on knowingly false premises, we may pursue counteraction through cease-and-desist demands, injunctive relief, or other available remedies. In such cases, the Buyer agrees to bear all associated legal and administrative costs.
If the Buyer engages legal counsel, and that attorney pursues claims that are demonstrably baseless, misleading, or in direct contradiction to documented facts and the agreed-upon terms, Majestic Reptiles reserves the right to file a formal grievance or complaint with the applicable state bar association or regulatory authority. This includes situations where the attorney fails to properly advise their client on the validity of their claims or acts in bad faith by advancing allegations that lack factual or legal merit despite being presented with clear documentation.
13.2 Survival & Enforceability
This clause shall remain fully enforceable irrespective of Seller fault and shall survive the transaction indefinitely.
Violation of this section constitutes a material breach of this Agreement and may result in legal action, including but not limited to claims for damages, injunctive relief, reputational harm, and permanent forfeiture of any refund eligibility or support.
14. Compliance with Local, State, and Federal Laws
The Buyer is solely responsible for researching, understanding, and complying with all applicable local, state, and federal laws or regulations related to the purchase, ownership, possession, transportation or importation of the animals sold by Majestic Reptiles. This responsibility includes, but is not limited to, compliance with applicable federal regulations such as the Lacey Act, CITES (Convention on International Trade in Endangered Species), and any U.S. Fish and Wildlife Service permitting or reporting requirements. Buyer acknowledges and affirms that any species subject to CITES, USFWS, or import/export restrictions have been verified as legal to receive and possess.
Majestic Reptiles does not, and is under no obligation to, verify whether any particular animal is lawful in the Buyer’s jurisdiction. Majestic Reptiles makes no guarantees or representations as to the legality of any animal in the Buyer’s city, county, state, or jurisdiction. This includes, but is not limited to, restrictions based on species, subspecies, or maximum allowable size or length. The Buyer expressly assumes all risk of purchase and possession, and understands that it is solely their responsibility to confirm that the animal is lawful to own at its current size and at its expected adult size under all applicable laws and regulations.
Majestic Reptiles shall not be held liable for any legal penalties, confiscation, seizure, regulatory action, or loss resulting from the Buyer’s failure to comply with applicable laws. Majestic Reptiles shall not be required to provide any refund, replacement, or credit if any governmental or regulatory authority seizes or prohibits the animal after purchase.
By completing a purchase, the Buyer affirms that they have verified the legality of the animal(s) in their jurisdiction and accept full legal responsibility for their possession and care.
15. Force Majeure
Majestic Reptiles shall not be liable for any delay, interruption, damages, or failure to fulfill its obligations under this Agreement due to circumstances beyond its control, including but not limited to: natural disasters, extreme weather, disease outbreaks or pandemics, government restrictions, labor strikes, transportation disruptions, supply shortages, shipping embargoes, cyberattacks, power outages, or acts of God.
16. No Waiver Clause
Failure by Majestic Reptiles to enforce any part of this Agreement at any time shall not be construed as a waiver of any provision or right, and shall not affect our ability to enforce the same at a later date.
17. Entire Agreement & Severability
This Agreement represents the entire and exclusive understanding between the parties with respect to its subject matter, superseding all prior or contemporaneous agreements, representations, or understandings. If any provision of this Agreement is held to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
In the event of ambiguity or dispute over any provision in this Agreement, no interpretation shall be made in favor of either party.
Any provision found invalid shall be deemed modified to the minimum extent necessary to make it enforceable while preserving the parties’ original intent.
18. Updates & Amendments
Majestic Reptiles reserves the right to amend, update, or modify these Terms & Conditions at any time, with or without prior individual notice. Such changes take effect immediately upon publication through any reasonable medium, including but not limited to digital communications, printed invoices, or online listings. Material changes may, at our discretion, also be communicated by email if contact information is available, and will always be prominently posted on the Majestic Reptiles website. Buyers agree that posting updated Terms on the website constitutes sufficient notice of any changes, and it is the Buyer’s responsibility to review the current Terms prior to any new purchase or interaction.
The most current version of the Terms governs all past, present, and future transactions. Buyer expressly agrees that continued possession of any animal purchased under any prior version of these Terms constitutes acceptance of the most current version of these Terms as updated from time to time. By continuing to engage with Majestic Reptiles in any capacity—including but not limited to contacting us, requesting support, reselling animals, or initiating disputes—Buyer agrees to be bound by the prevailing version of these Terms, regardless of where or how the purchase was made.
This does not retroactively impose new obligations on transactions already completed. However, it does confirm that any continuing obligations (such as restrictions on resale, non‑disparagement, or dispute resolution procedures) remain subject to the most current Terms.
19. Headings for Convenience Only
Section titles and headings in this Agreement are for convenience only and shall not affect the interpretation of any provision.
20. Acknowledgment
Buyer certifies that they have read, understood, and agreed to the Terms & Conditions before purchasing any animal. Completion of a purchase constitutes full acceptance of this Agreement, regardless of where the purchase was made, whether on our website, advertisement, or marketplace.
